Assisting Members with Legal Representation
The Building Industry Association of Washington's Legal Program champions the cause
of builders and developers trying to survive in a growing and turbulent sea of
regulations. BIAW tirelessly fights unauthorized agency rulemaking and unscrupulous
local government demands with astounding success, making itself a force to be
reckoned with in all courtrooms of the state.
BIAW's Legal Program has grown rapidly in recent years, now boasting three in-house
attorneys with experience in the courtroom, judicial chambers, and the Legislature.
BIAW's in-house attorneys answer members' legal questions, represent them in crucial
cases, and ensure they are informed on changes in the law that could affect their
businesses--all free of charge.
BIAW attorneys file more lawsuits against government agencies than any other trade
association in the state. These lawsuits challenge rulemaking and regulatory actions
that deprive builders of private property rights and undermine the free market system.
When a member is intimidated by the prospect of filing a case or just can't afford
the process, BIAW can step in and provide funding, submit supporting briefs, or
even serve as the plaintiff.
BIAW members and friends can help by watching for cases in which government is acting
illegally or overstepping the bounds of its authority. High priority cases are those
that tackle impact fees, property rights, moratoriums, and critical area restrictions,
although any case that will set valuable precedent for members statewide will be
considered.
